GRINNELL'S LITIGATION COUNT STILL CLIMBING

Grinnell has been mired in over 1,400 state and local courtsuits. FPC has undertaken a comprehensive program of gathering and reporting on every available court suit involving Grinnell. This effort is intended as a pilot program to examine the impact of litigation on the construction industry. FPC was amazed that our first pass at Grinnell’s litigation history revealed the company was a plaintiff or defendant in over 1,100 local and state court cases. At this time, FPC has only checked local courts in 25 states through June, 1999.

Now FPC has conducted initial research of federal district court records. Grinnell is a party in over 300 federal court cases, according to our research. This

raises the total number of Grinnell court suits known to FPC to over 1,400. When FPC finishes checking the other 25 states, and updating court searches to include the last six months, it is likely that Grinnell will be implicated in at least 2,000 court suits.

Federal Court Summaries - following are summaries of 46 of the more than 300 Grinnell Federal Court cases. These facts are taken from the docket reports. FPC will provide a more complete reporting on these cases in future issues.

Contract Disputes - Grinnell was plaintiff or defendant in 12 contract dispute suits. The amount of money damages sought was given in only four of these cases. The total amount of alleged, known damages totaled $1,357,000 in just four of those cases.

GRINNELL v. CD Cont. - This E Wash. case was a contract dispute that was dismissed.

GRINNELL v. PCL - This was a Minnesota contract dispute. (93-8650

Alexander Alexandre v. GRINNELL - This was a New Hampshire contract dispute.

Angle v GRINNELL - This is a breach of contract suit against Grinnell in North Carolina. (95-437)

GRINNELL v. Industrial Pipe - GRINNELL charged breach of contract in this Georgia case.

GRINNELL V. Beacon Construction - This was a 1998 case over a contract payment dispute in Georgia.

Canfield, USA v. GRINNELL, others - The plaintiffs charge that Grinnell, others, owed $283,000 in this contract payment dispute in Georgia.

GRINNELL v. American Electrical Services - Grinnell sued for $179,000 in this Louisiana contract dispute.

Brewster Nursing v. GRINNELL - Grinnell was sued in this Mass. contract dispute case.

Northeast Office v. GRINNELL, others - $745,000 was at stake in this Massachusetts contract dispute.

GRINNELL v. Jersey Equipment (92-2555) - Grinnell sued for $150,000 in this contract dispute.

Property Damages - Grinnell was the defendant in four property damage cases. The total of damages sought totaled $2,583,000 in three of the cases and was not given in the fourth case.

Allstate Insurance, Brooke Ridge Condos V. GRINNELL - This insurance company, and these property owners, sued Grinnell for $335,000 in property damages. On May 1, 2000, the judge denied Grinnell’s motion of reconsideration of an earlier order. The case is pending.

Ladd Furniture v. GRINNELL, others (98-7039) - This suit claimed $590,000 in prop- erty damages sought from Grinnell and others in Ohio.

US Fidelity v. GRINNELL, others (99-272) - This pending property damages case in Washington asked for $1,658,000 from Grinnell and others.
