Guenther provided false information on a Contractor’s Qualification Statement

Although Guenther also answered "NO" to the question of whether there was any litigation pending against them, a former employee had sued Guenther earlier that same year.

Guenther, like all companies bidding on public works projects in Ohio, filled out a Contractor’s Qualification Statement as part of the process in bidding on the Medina Junior High School job. When it came time for Guenther to answer the question "has your organization ever filed any law suits ... with regard to construction contracts within the last five years?" Guenther answered "NO." However, court records show that Guenther sued one of their own subcontractors on a prison job just two years earlier. Although Guenther also answered "NO" to the question of whether there was any litigation pending against them, a former employee had sued Guenther earlier that same year. While some people may pad their resume now and then, these statements were different. Guenther’s statement, in contrast to a resume, was sworn and notarized to be "true" and "not misleading."
