THE CITY OF SPOKANE MAINTENANCE CHIEF SUED C & R FOR MAINTAINING AN UNSAFE WORK PLACE

C & R Plumbing had a contract with the Spokane Arena, and part of their duties were to train City workers in how to conduct facility maintenance. During one such training session, a C & R Employee placed a ladder against a wall in the Veterans Memorial Arena. The City Maintenance chief, Gary Horsman, was then directed by C & R Plumbing to climb the ladder. C & R had installed the ladder on a slippery floor, without using top hooks, a spotter, or other safety features. Horsman and the ladder fell. Horsman suffered severe, disabling, and permanent injuries. Horsman sued C & R and others in September, 1988.

GILBANE BUILDING COMPANY, A LARGE GENERAL CONTRACTOR STATED IN WRITING THAT C & R IS NOT A QUALIFIED CONTRACTOR

Inside the close-knit construction industry, few contractors are willing to blow the whistle on one another. This is because you never know who is going to be supervising the next job, and if you speak against one contractor, he may provide evidence against you soon. That is why it is so rare to find correspondence like the May, 1999 letter that Gilbane Building Company sent to C & R Plumbing, regarding C&R’s desire to bid on work at the Washington State University Recreation Center Project. The letter plainly stated:

"C & R Plumbing & Heating is not qualified to bid the WSU Student Recreation Center Project. Furthermore, if C&R does submit a bid proposal, it will be rejected and not opened. Also, if C&R submits a bid as the second tier subcontractor through another prime mechanical contractor, that bid will be declared non-responsive."
