All Problems for all temperatures

Certificate of Insurance on the Deloitte & Touche HVAC re-work project

All Temperatures Controlled furnished their most current Certificate of Insurance regarding the Hathaway Dinwiddie job at the Deloitte & Touche HVAC re-work project. In response, Jackie Sarosi fired back a letter to All Temperatures on December 18, 2000, noting several problems with their insurance. Most importantly, All Temperatures insurance company was not an "A" directory rated insurance company. An "A" rated insurance company was required on that particular job. The certificate also lacked a proper waiver with regards to workers compensation. Also, the wording of the cancellation provision was not acceptable. (Job #6010-03)

More companies find problems with All Temperatures Controlled

Kemp Brothers Construction was also unhappy with the scope of All Temperatures insurance. Kemp Brothers wrote to All Temperatures on October 23, 2000 stating "...Incorrect insurance, does not name any projects owners, architects or engineers," and asking that All Temperatures have their carrier add additional blanket general liability insurance. All Temperatures problems with insurance did not end there. On December 1, 2000, American Management Control Systems also wrote to All Temperatures. American Management monitors the insurance coverage of All Temperatures on behalf of ARCO Products Company, and American Management noticed that All Temperatures insurance policy was due to lapse in 30 days. In December 2000, All Temperatures tried to bill $2,700 to Crabb Construction Company of Covina for a balance due on work performed. Crabb’s response was "The metal roof on the trash corral was not done and is not going to be done–so there should not be a charge for it!"

Prospective employees file with the National Labor Relations Board

In September 2000, seven prospective employees of All Temperatures filed National Labor Relations Board charges against the company claiming that they had been interrogated about their union membership and had been refused jobs. Instead of hiring skilled union members, apparently All Temperatures has preferred to hire whomever is sent over from Labor Ready. (NLRB Case #31-CA-24754)

The questionable arrangements between All Temperatures and Labor Ready have already attracted the attention of California government investigative agencies. The California Department of Industrial Relations, Division of Labor Standards Enforcement has already found that All Temperatures has violated state labor laws on the Wilson Senior High School job for the Los Angeles Unified School District. All Temperatures was ordered to forfeit $20,350 to the school district, according to correspondence dated July 18, 2000 sent to the Mission Community Hospital who had considered hiring All Temperatures Controlled.

In addition, this large sanction against All Temperatures has alerted yet another government agency to All Temperatures potential wrong doing. Now the Los Angeles Unified School District’s Equal Opportunity Section has begun its own investigation of All Temperatures regarding its work at Canoga Park Senior High School, Reseda Elementary School, San Jose Elementary School and Taft Senior High School.
